Could someone tell me the position regarding authors or publishers using the
same book title previously used by another author. I have 2 travel books
with the title Seven League Boots. One is written by Wendy Myers and was
published by Hodder & Stoughton in 1969. The other is written by Richard
Halliburton and published by Geoffrey Bles in 1936.
Is this common practice in the publishing world ?

Probably isn't a common (or smart) practice, but Peter Lovesey wrote The
Last Detective in 1991 and Robert Crais wrote The Last Detective in 2003.

The title "Passport To Danger" was used first on a Nancy Drew-Hardy Boys
Supermystery several years ago then used again on a Hardy Boys Digest last
year.

The worst example I have ever seen is this and both are mystery stories
to boot:


Ted Wood, Dead in the Water (Scribners 1983)
Stuart Woods, Dead in the Water (Harper Collins 1997)

Franklin W. Dixon, Dead In The Water (Archway 1998).

The copyright office has issued a circular specifically answering that
question.

Since it's a government publication, and since I've now refreshed my memory
on the issue by fruitlessly reading most of the actual law looking for this,
I know it's perfectly legal to quote the thing verbatim:

But names of products used in commerce can be trademarked (though not
copyrighted). That would probably not apply to a book, however, unless
it was one that was put out repeatedly, such as "The Michelin Guide".
One thing to remember is that law is complex, and the absence of
authority in one area (e.g., copyright) does not mean an absence of
authority in another area (e.g., trademank).

You bring up an interesting point about "The Michelin Guide" and similar
works. Someone with a copy might find the information as to trademark of the
title included in the book.

And then there is Michael Crichton's THE LOST WORLD, which not only used the
title of Arthur Conan Doyle's 1912 classic but ripped off the basic plotline
(here and in JURASSIC PARK) as well. . . .

Mark Harrison, author of the 2001 Xlibris book True North, may be a little
consternated by the release of Jim Harrison's new novel, True North. Or maybe
he's looking forward to a sales windfall.
