RE: Harry Leak

Judge Peskind,

I have known Harry Leak for the past 4 year's. Mr. Leak and I have
been doing business on a regular basis since I met Harry. When I
first met Harry he was just released from Prison. I have seen Harry
grow emotionally and financially he frequent's my store as a customer
as well as a friend. My store is located across the street from the
Delray Beach Police and Fire Department alot of Police Officer's and
Fire Fighter's do construction on the side on a regular basis. I have
refered Harry and all I heard were good thing's and eveeryone said
they would not hesitate to give Harry more work.

Harry has grown a great deal as a person as well as a business man. I
have has expressed his guilt for what happened in Wisconsin. His
usual upbeat tempo has not been there lately and I asked him what was
wrong ? and he said Luke I am scared to death that if I have to go to
jail my family will suffer and that I will proabley lose everything I
worked these last 4 years to get.From what Harry has told me about the
crime he committed and I said Harry it sound's like petty theft and he
told me that the actual crime he committed was a misdeameanor but due
to my past record the State of Wisconsin enhanced it to a felony. It
sound's to me that The State of Wisconsin is making Harry pay for his
past againwhich in my opinion is not right.But the law is the law I
have neber been in any trouble and feel if a person commit's a crime
there should be a price to pay for the crime they committed and not be
judged by there past.

In the past four year's that I have known Harry all I can say is good
thing's about him. Harry is a very responsible man I usually do not
do business unless the customer pay's in full Harry never stiffed me
and alway's paid his bill the day he said he would . Harry is a loving
and caring fatherhis son Tyler is his life and Harry is Tyler's
lifeWhen you see Harry Tyler is not far behind or in his arm's . I
personally feel incarcerating Harry will not accomplish anything other
than him losing everything he has worked for over the last few year's
.. Yes Harry has a loving caring Mother but she will not be able to
provide financially for Tyler. There is no doubt that Harry committed
a crime and hopefully you will be compasionate and sentence Harry
accordingly for the crime he comitted and not look at his past . Harry
is a very productive member of society and our community . Harry has
stated to me how shameful and guilty he feel's for his action's that
day in Wisconsin. In my opinionion Harry deserve's another chance to
prove himself to you and his family hopefully your honor you will find
another alternative other than jail so harry is able to provide for
his family
